
The Tripartite Council of Khanbogd soum (TPC) was established in 2015 with equal representation of the Khanbogd soum administration, the herder community, and Oyu Tolgoi LLC. The TPC is the engagement platform for the parties to inform and address various topics related to the herders, pasture and water.
It started from the dispute resolution process of two complaints that were formally lodged to Office of the Compliance Advisor/Ombudsman (CAO) by the local herders in 2012 and 2013.
After almost five years of dispute resolution, in May 2017, the parties reached two sets of Herders Complaint Resolution Agreements to resolve complaints related to the Undai River diversion and the 2004 & 2011 resettlement and compensation process. The agreements identified 59 actions, KPI and the responsible parties for each action.
In November 2018, the TPC concluded that complaints were resolved sufficiently and TPC activities would continue based on the trust established among the parties without CAO involvement.
CAO has officially concluded its involvement in the dispute resolution process after monitoring implementation of the agreements to the parties’ satisfaction. In March 2019, CAO and TPC convened a formal case closure meeting in Khanbogd and a knowledge-sharing event in Ulaanbaatar which included participants from the private sector, civil society, government and international donor and development organizations.
